Hello all, so i am in kind of a pinch and need some advice on what i should do or can do. So last may i went down to north Carolina to buy a 08 puma (i live in Minnesota) so anyway i met the guy and we went to his credit union i paid him for the boat and everything was great. We did notarized bill of sale for the boat,trailer,and motor. the owner said he would mail me the title so i felt comfortable since i had the bill of sale and we did all this with a banker. So i got the title for the boat but not for the trailer. Well this guy who i thought was a straight guy has really turned out to be not such a good guy. It has been 6 months i have emailed him text messaged him and called him about 100 times and he wont even call me back. I tried to register the trailer at my local dmv and they said the state of north Carolina has trailer titles and i would need that to register the trailer. since then i have got about 400.00 dollars in fines for not having the trailer registered and im starting to get very angry. It was kind of a goofy deal to begin with i think the guy was in money trouble because according to him he bought it from the original owner and only owned it for 1 year before he had to sell it to me. So i dont know if the guy i bought it from never got a trailer title to begin with and thats why he wont call me back. So before you tell me im an idiot i know and lesson learned i was so excited to get this boat i had searched for a cat for a long time and felt comfortable seeing that we did all this at a bank. I would try to call the bank but the lein release that came with the title was only for the boat and motor so im guessing they never had the trailer title to begin with. I should have been more aware of all this when i bought the boat but im an idiot and couldnt stop staring out the office window of my new boat in the parking lot not to mention my Buddie and i just drove 24 hours straight with no sleep the night before and living on red bull and gas station food. So if anyone has any info or advice that can help me solve my title issue i would be very grateful. Im not sure if there is a way to find out who the trailer is registered to by secrial number or what. like i said i do have a notarized bill of sale to prove i bought it. i would not be going through this if people where honest this is the kind of stuff that ruins it for good people out there. Alright 2008 is short so you can fix this. The person is one way and you also can file lost title in your state, this is easiest . We can produce a duplicate MSO if its lost. We can send to original owner, with forwarding envelope for successive owner, then forward to you, with forwarding envelope also. They would have form signing ownership and debt load, and it also must be notarized. Though everyone may not be willing andwe are looking for help. Then again you could put his name out for all to see if this fails. That may put you out there though it sure wont help his local reputation either.
I am not sure if it would help but you could file a complaint with the N.C. Attorney Generals office. They may be intrested if there is/was an intent to commit fraud.

Although I live in CA the laws are similar. As long as you have the guys name and address or phone number you should be able to fill out a Statement of Facts form with your DMV. In the form you just need to state that all attempts to contact the seller of the trailer have been unsuccessful. If you have his address send a letter Certified Mail Return Receipt Requested and when you get no response that will help you out even more. Have a photo copy of the Return Receipt to give to DMV. As long as the price you purchased the trailer for or the value of the trailer is low $300.00 , $200.00 (you get my drift) and DMV records do not show any liens on the trailer. Which it shouldnt if the boat is free and clear the trailer should be as well. They should be able to accept that as proof that you can not get in touch with the current legal owner of the trailer. Pay whatever back taxes or registration fees and fines you have incurred. One other note about dealing with the DMV. Be patient. Be humble do not get frustrated. If you cant get help at one office go to another. It will be a game of hit and miss until you reach someone who knows the system inside and out and is willing to help you. By hook or by crook you can get this done. By crook I mean removing the dealer stamp and registering it as a home built trailer. There is more to this but you get the idea. Lien Sale. If you can not do it as a citizen befriend someone who has a tow yard or mechanic. A title bond. Ill stop there. I dont want you to get the wrong impression about me and my morals. When you are desperate youll do almost anything especially when you are getting the run around. Hope this helps. Hang in there.
Thanks guys for all your help and input. I did forget to mention that there is a sticker on the trailer from brech marine. I think it is located in Alabama my guess is the guy i bought the boat from never registered the trailer or didnt get a title but at this rate who knows what the deal is. The guy i bought the boat from is named GRADY WAYNE JOYNER from lucama n.c. Like i said he seemed like a straight shooter when i bought the boat but now he has definitely proved me wrong. The vin on the trailer is 458BC222981010030 I just want what is rightfully mine and what i paid for. Like i said i do have a notarized bill of sale on the trailer but dont know how far thats gonna get me if the trailer isint even in his name. I Have called this guy about 100 times and wont respond no matter what i do i have been nothing but kind in all of my messages but now am starting to get angry for obvious reasons. Every time i get his voice mail it is still him on the voice mail so i know hes getting the messages but chooses to avid me. For what its worth, if the trailer did originate in Alabama, or passed through Alabama, there is no registration or titling of any sort on boat trailers.
Having a notarized bill of sale is nice but as you know it is worthless if the person you bought it from is not the legal owner. DMV needs proof that the registered owner has sold you his property. If you dont have the actual title then a current registration with matching names on the bill of sale should do. Baring those two documents you should be able to fill out a Statement of Facts form. Keep at it I know its a pain in the butt, try your hand at going to a different DMV office and explain your situation and ask them how to remedy the problem. If they give you the run around go to anther. You should run in to some help because you are the one who actually is following the law and doing what you are supposed to do and register the trailer in your name. It seems like it was passed from person to person and no one else could careless about making a legal transaction.
